Terms of Service

These Terms of Service (“Terms”) govern your use of the OCTANE mobile application (the “App”) operated by OCTANE HEALTH (“we”, “us”, or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Account Registration

To use the App, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 16 years old to use the App.

2. Subscription Plans

The App offers two subscription tiers:

  • Athlete — Includes core workout and meal tracking with limited AI features (daily caps on AI chat, meal analysis, and food suggestions).
  • Olympian — Includes all Athlete features plus expanded AI limits, voice coaching, and real-time AI tools.

New accounts receive a free trial period. After the trial ends, continued access to AI features requires an active subscription. Non-AI features (workout logging, meal tracking, presets) remain available to all users.

Billing & Renewals

Subscriptions are billed through Apple’s App Store or Google Play Store. Payment is charged to your App Store or Play Store account. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your device’s subscription settings.

Refunds

Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.

3. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to other users’ accounts or our systems
  • Reverse engineer, decompile, or disassemble the App
  • Use automated scripts, bots, or scrapers to access the App
  • Abuse the AI coaching features (e.g., attempting to circumvent rate limits or usage caps)
  • Upload harmful, offensive, or illegal content through the chat or meal photo features
  • Share your account credentials with others
  • Resell or commercially exploit the App or its content

4. AI & Health Disclaimer

The App is not a medical device and is not regulated by any health authority. It provides AI-powered fitness coaching, workout recommendations, and nutritional analysis for informational and educational purposes only. These features do not constitute medical, nutritional, dietetic, physiotherapy, or professional fitness advice.

No professional relationship is created between you and OCTANE HEALTH, its developers, or the AI coaching features. The AI coach is a software tool — it is not a doctor, dietitian, physiotherapist, or certified personal trainer.

  • AI-generated meal analyses are rough estimates and may be significantly inaccurate. Do not rely on them for medical dietary requirements, allergy management, or any clinical purpose.
  • AI workout recommendations are based on your logged history and general fitness principles. They may suggest weights, reps, or exercises that are inappropriate for your individual circumstances. They are not a substitute for guidance from a qualified personal trainer or medical professional.
  • Voice coaching and chat responses are generated by third-party AI models (OpenAI) and may contain errors, hallucinations, or inappropriate suggestions.
  • Progressive overload recommendations are algorithmic suggestions only. You are solely responsible for selecting weights and exercises that are safe for your body.
  • Always consult a healthcare provider before starting a new exercise programme or making significant dietary changes, especially if you have any medical conditions, injuries, or are pregnant.

5. Assumption of Risk

Physical exercise carries inherent risks including but not limited to muscle strains, joint injuries, cardiovascular events, and in rare cases, serious injury or death. By using the App to guide your fitness activities, you acknowledge and voluntarily assume all such risks.

You are solely responsible for:

  • Determining whether any exercise, weight, or dietary recommendation is appropriate for your individual health status and fitness level
  • Using proper form and technique during all exercises
  • Stopping any activity that causes pain, dizziness, or discomfort
  • Seeking medical clearance before beginning any new exercise programme

OCTANE HEALTH expressly disclaims any responsibility for injuries, health complications, or adverse outcomes arising from your use of the App’s workout recommendations, meal analysis, or AI coaching features.

6. Health Data

If you choose to connect Apple HealthKit or Google Health Connect, the App will read health data (sleep, steps, active energy) to provide more personalized coaching. This data is used solely within the App and is handled according to our Privacy Policy. We comply with Apple’s HealthKit guidelines and Google’s Health Connect requirements.

7. Intellectual Property

The App, including its design, code, AI models integration, and content, is owned by OCTANE HEALTH and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Content you create (workouts, meals, chat messages) remains yours. By using the App, you grant us a license to process this content as necessary to provide the service (e.g., sending messages to OpenAI for AI responses).

8. Account Deletion

You may delete your account at any time through the App. Account deletion permanently removes all your data including workouts, meals, chat history, health metrics, AI personality data, and subscription information. This action is irreversible.

If you have an active subscription, cancel it through your device’s subscription settings before deleting your account to avoid continued billing.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activity that harms other users or the integrity of the service. Upon termination for cause, your right to use the App ceases immediately.

10. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Without limiting the foregoing, OCTANE HEALTH does not warrant that:

  • AI-generated nutritional estimates, workout recommendations, or coaching advice will be accurate, complete, or appropriate for your circumstances
  • The App will be uninterrupted, error-free, or free of harmful components
  • Any data or content will be secure or not otherwise lost or damaged

11. Limitation of Liability

To the maximum extent permitted by applicable law, OCTANE HEALTH, its directors, employees, agents, and developers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of (or inability to use) the App, including but not limited to:

  • Physical injuries, illness, or death resulting from following AI-generated workout recommendations or exercise suggestions
  • Health issues, allergic reactions, or adverse outcomes resulting from reliance on AI-generated nutritional estimates or dietary information
  • Decisions made based on AI coaching advice, voice mode conversations, or progressive overload recommendations
  • Loss of data due to technical failures or account deletion
  • Interruption or unavailability of service

In any event, our total aggregate liability to you for all claims arising from or related to the App shall not exceed the total amount you have paid to OCTANE HEALTH in subscription fees during the twelve (12) months immediately preceding the event giving rise to the claim, or fifty pounds sterling (£50), whichever is greater.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under English law.

12. Indemnification

You agree to indemnify, defend, and hold harmless OCTANE HEALTH, its directors, employees, agents, and developers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the App; (b) your violation of these Terms; (c) any injury or harm to yourself or others resulting from activities you undertook based on information provided by the App; or (d) your violation of any applicable law or regulation.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms in the App and updating the “Last updated” date. Your continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. You and OCTANE HEALTH agree to submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes arising from these Terms or your use of the App.

Before initiating formal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of at least thirty (30) days from written notice of the dispute.
